Rubbish Removal Brentford Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Removal Brentford provides waste collection and rubbish removal services. By making a booking, you agree to be bound by these Terms and Conditions, which form a contract between you and Rubbish Removal Brentford.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, business or organisation requesting and paying for the services.
Services means any rubbish removal, waste collection, clearance, loading, transportation, and related services provided by Rubbish Removal Brentford.
Waste means any rubbish, junk, household waste, commercial waste, garden waste or other materials agreed to be removed under the Services, subject to applicable waste regulations.
Contract means the legally binding agreement between the Customer and Rubbish Removal Brentford incorporating these Terms and Conditions and the details of the booking.
2. Scope of Services
Rubbish Removal Brentford provides waste collection and rubbish removal services for domestic and commercial customers within its operational service area. Services may include collection, loading, transportation and disposal or transfer of Waste at licensed facilities in accordance with applicable waste management regulations.
The specific Services to be provided, the estimated quantity or volume of Waste, the collection address, and the proposed date and time window for service will be agreed at the time of booking, either by telephone, email, online form or any other booking method offered by Rubbish Removal Brentford.
Rubbish Removal Brentford reserves the right to refuse to remove any items or Waste that it reasonably believes to be hazardous, unlawful to transport or dispose of, unsafe for its staff to handle, or outside the agreed scope of the Services.
3. Booking Process
3.1 Booking request
The Customer may request a booking by providing accurate details of the location, type and approximate volume or weight of the Waste, any issues relating to access or parking, and any special requirements. Rubbish Removal Brentford may rely on the information provided when issuing a quotation or estimate.
3.2 Quotations and estimates
Any quotation or estimate provided before arrival at the collection address is based on the information supplied by the Customer. Quotations are not binding until the Waste has been inspected on site. If on arrival the Waste differs significantly from the information provided, Rubbish Removal Brentford may adjust the price or refuse part or all of the job.
3.3 Confirmation of booking
A booking will be confirmed once the Customer has accepted the quotation or agreed to proceed verbally or in writing, and Rubbish Removal Brentford has confirmed a date and time window for service. Rubbish Removal Brentford may, at its discretion, require a deposit or full payment in advance to secure the booking.
3.4 Time windows and delays
Any time or date for performing the Services is an estimate only. While Rubbish Removal Brentford aims to attend within agreed time windows, it does not guarantee specific arrival times and will not be liable for any loss or inconvenience arising from delays due to traffic, weather, access issues, vehicle breakdowns or other circumstances beyond its reasonable control.
4. Customer Obligations
The Customer agrees to:
Provide accurate information about the Waste and the premises at the time of booking.
Ensure that Rubbish Removal Brentford and its staff have safe, reasonable and lawful access to the premises, including suitable parking for the collection vehicle where required.
Ensure that the Waste to be removed is clearly identified and separated where necessary from items that are to be kept.
Obtain any necessary permissions, permits or consents for access, parking or Waste removal from property owners, managing agents, local authorities or other relevant parties.
Supervise the removal where necessary and check that only the intended items are taken.
Where applicable, ensure that any electrical, gas or water appliances are safely disconnected and ready for removal before the Services commence.
If the Customer fails to meet these obligations, Rubbish Removal Brentford may refuse or suspend the Services and may charge a call-out fee or additional costs reasonably incurred.
5. Waste Types and Restrictions
Rubbish Removal Brentford will only remove Waste that is lawful to transport and dispose of under current waste regulations. Certain items and materials are restricted or prohibited, including but not limited to:
Hazardous waste such as asbestos, certain chemicals, solvents, paints, oils, clinical or medical waste, sharps, or biological materials.
Pressurised containers, gas bottles, explosives, firearms, or ammunition.
Liquids, fuels or materials that may leak or spill during transport.
Any items that, in the reasonable opinion of Rubbish Removal Brentford, may pose a health and safety risk to staff or others.
If restricted or prohibited items are discovered during the collection, Rubbish Removal Brentford may refuse to remove them and may charge for any time lost or additional handling required. It is the Customer's responsibility to disclose the nature of the Waste fully and honestly prior to the Services being carried out.
6. Pricing and Payments
6.1 Pricing structure
Charges are generally based on the volume and type of Waste collected, the labour involved, access conditions and any additional services requested, such as dismantling or extra loading time. Prices may also reflect current disposal and recycling costs.
6.2 Estimates on site
On arrival, Rubbish Removal Brentford will inspect the Waste and confirm the final price before beginning the work. If the Customer does not agree to the revised price, the Services will not proceed, and a call-out or attendance fee may be charged if this was explained at the time of booking.
6.3 Payment terms
Unless otherwise agreed in writing, payment is due immediately upon completion of the Services. Rubbish Removal Brentford accepts various payment methods, which may include cash, card payments or bank transfers, subject to availability at the time of service.
For business customers with approved accounts, payment terms may be agreed separately. If payment is not made by the due date, Rubbish Removal Brentford reserves the right to charge interest on the overdue amount in accordance with applicable UK law and to recover any reasonable costs incurred in pursuing late payment.
6.4 Invoices and receipts
Upon request, Rubbish Removal Brentford will provide a receipt or invoice detailing the Services provided, the amount of Waste removed and the total charges. The Customer should retain these documents for their records.
7. Cancellations and Amendments
7.1 Customer cancellation
The Customer may cancel or reschedule a booking by giving reasonable notice before the agreed arrival time. Rubbish Removal Brentford may specify a minimum notice period, for example 24 hours, for cancellations without charge. If the Customer cancels with insufficient notice, a cancellation fee or loss of any deposit paid may apply to cover administrative and scheduling costs.
7.2 Failed collections
If Rubbish Removal Brentford attends the premises at the agreed time and is unable to carry out the Services due to the Customer's failure to provide access, parking, accurate address details or adequate instructions, or because the Waste is not as described, a call-out or failed collection fee may be charged.
7.3 Cancellation by Rubbish Removal Brentford
Rubbish Removal Brentford may cancel or reschedule the Services at any time if it is unable to perform them safely or lawfully, or due to circumstances beyond its reasonable control. In such cases, any deposit or prepayment for Services not performed will be refunded or credited, and this will be the full extent of Rubbish Removal Brentford's liability for cancellation.
8. Performance of the Services
Rubbish Removal Brentford will carry out the Services with reasonable care and skill, in accordance with industry practice and in compliance with applicable waste regulations. Staff will take reasonable steps to avoid damage to property and will follow appropriate health and safety procedures.
However, the Customer acknowledges that the nature of rubbish removal and waste collection, especially in confined spaces, stairwells, or areas with limited access, can involve some risk of minor damage to walls, floors, fixtures, or surrounding items. The Customer should remove or protect any items of particular value or fragility before the Services commence.
9. Liability and Limitations
9.1 General liability
Rubbish Removal Brentford will be liable for direct loss or damage caused by its negligence or breach of these Terms and Conditions, subject to the limitations set out below. Nothing in these Terms and Conditions shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.
9.2 Exclusions
Rubbish Removal Brentford will not be liable for:
Any loss or damage arising from inaccurate or incomplete information provided by the Customer.
Any loss resulting from the removal of items where the Customer has failed to properly identify items to be removed or retained.
Indirect or consequential loss, loss of profits, loss of business, loss of opportunity or any similar economic loss.
Loss or damage to items that the Customer has failed to safeguard or protect, where such loss or damage could reasonably have been avoided.
9.3 Financial cap
Subject to the above, the total liability of Rubbish Removal Brentford under or in connection with any Contract shall not exceed the total price paid or payable by the Customer for the Services to which the claim relates.
10. Waste Transfer and Environmental Compliance
Rubbish Removal Brentford will handle, transport and transfer Waste only to appropriately licensed or permitted facilities, in accordance with applicable waste management and environmental regulations in the United Kingdom. Where required, Rubbish Removal Brentford will complete written records, such as waste transfer notes, as part of its compliance obligations.
The Customer acknowledges that, once Waste has been collected and the Services completed, ownership of the Waste transfers to Rubbish Removal Brentford or its appointed waste management partners, who will determine the appropriate method of treatment, recycling or disposal in line with regulatory requirements.
11. Customer Warranties
The Customer warrants that:
They are the owner of the Waste or have the full authority of the owner to arrange for its removal.
The Waste does not contain any restricted or hazardous materials that have not been disclosed.
The removal of the Waste will not contravene any law, regulation, lease, or third-party rights.
The Customer will indemnify Rubbish Removal Brentford against any claim, cost, or liability arising from a breach of these warranties.
12. Complaints and Dispute Resolution
If the Customer is dissatisfied with any aspect of the Services, they should notify Rubbish Removal Brentford as soon as possible, providing full details of the issue. Rubbish Removal Brentford will investigate the complaint and, where appropriate, offer a remedy which may include a partial refund, a re-visit, or another reasonable solution.
Both parties agree to attempt to resolve disputes amicably in the first instance. If a dispute cannot be resolved informally, either party may seek resolution through appropriate legal channels in accordance with the governing law clause below.
13. Data Protection and Privacy
Rubbish Removal Brentford may collect and process personal information about the Customer for the purposes of managing bookings, providing Services, handling payments, and dealing with queries or complaints. Any personal data will be handled in accordance with applicable data protection laws in the United Kingdom.
By making a booking, the Customer consents to the use of their personal information for these purposes. The Customer may request access to, or correction of, their personal data by contacting Rubbish Removal Brentford.
14. Variations to Terms
Rubbish Removal Brentford may update or amend these Terms and Conditions from time to time to reflect changes in law, best practice or the scope of its Services. The version in force at the time of the Customer's booking will apply to that Contract. Customers are encouraged to review the current Terms and Conditions before each booking.
15. Severability
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.
16. Governing Law and Jurisdiction
These Terms and Conditions and any Contract between the Customer and Rubbish Removal Brentford are governed by and construed in accordance with the laws of England and Wales.
Any disputes arising out of or in connection with these Terms and Conditions or the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales, to which both parties irrevocably submit.
17. Entire Agreement
These Terms and Conditions, together with any written quotation, booking confirmation or invoice issued by Rubbish Removal Brentford, constitute the entire agreement between the parties in relation to the Services and supersede any prior representations, statements or understandings, whether oral or written, relating to the subject matter of the Contract.
By confirming a booking for rubbish removal or waste collection with Rubbish Removal Brentford, the Customer acknowledges that they have read, understood and agree to be bound by these Terms and Conditions.
